These Terms of Service ("Terms") constitute a legally binding agreement between you and Novastro ("Novastro," "we," "us," or "our"), regarding your access to and use of the Novastro website (novastro.co) and mobile application (the "App").

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE OUR SERVICES.

1. Description of Services

Novastro is an AI-powered astrology application that provides personalized insights, birth chart calculations, and chat experiences based on planetary data. Entertainment Purposes Only: The Services and insights provided by our AI are for entertainment purposes only. They are not intended to be, and should not be taken as, medical, psychological, financial, or legal advice.

2. Eligibility

The Services are available only to individuals who are 13 years of age or older. By using Novastro, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Accounts and Security

To use certain features, you may be required to register an account. You agree to provide accurate, current, and complete information (specifically your birth data for accurate chart calculation). You are responsible for maintaining the confidentiality of your account credentials. Novastro is not liable for any loss or damage arising from your failure to protect your account.

4. Purchases and Refunds

4.1. In-App Purchases: Novastro offers subscriptions and digital goods exclusively through the Apple App Store and Google Play Store.

4.2. Refund Policy: All purchases are final. Novastro does not process refunds directly. Refund requests must be directed to the store where you made the purchase (Apple or Google) and are subject to their respective refund policies.

4.3. Price Changes: We reserve the right to modify our pricing at any time. Changes will apply to subsequent billing cycles.

5. Modifications and Updates to the App

5.1. Right to Modify: Novastro reserves the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.

5.2. Updates: We may provide enhancements, bug fixes, or updates ("Updates") from time to time. You agree that Novastro has no obligation to provide any Updates or to continue to enable any particular features. All Updates will be deemed part of the App and subject to these Terms.

6. Use of AI Technologies

6.1. AI Generation: The App utilizes artificial intelligence technologies and Large Language Models ("LLMs") provided by third parties (including but not limited to OpenAI, Google Gemini, xAI/Grok, and others) to generate content. The information provided may be incomplete, inaccurate, or not unique.

6.2. No Reliance: AI-generated responses should not be relied upon as factual or professional advice. Users are solely responsible for their inputs and how they interpret the outputs.

6.3. Commercial Use Prohibited: Use of the AI features for commercial purposes, or using the data/outputs to train other AI/ML models, is strictly prohibited.

6.4. Third-Party Dependency: The App relies on these third-party APIs to function. We do not control these providers and cannot guarantee their availability, speed, or accuracy.

7. NO WARRANTIES

THE APP IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, NOVASTRO EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITATION TO THE FOREGOING, NOVASTRO PROVIDES NO WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE WITH ANY OTHER SOFTWARE OR SYSTEMS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE.

8. Intellectual Property

8.1. Ownership: The App, including its text, graphics, logos, code, and AI system design, is the property of Novastro and is protected by copyright, trademark, and other intellectual property laws.

8.2. Restrictions: You may not:

Reverse engineer, decompile, or disassemble the App.
Scrap or harvest data from the App.
Copy or reproduce any part of the App without our written consent.

8.3. User License: By submitting your birth data, you grant us a limited license to use this data to generate your charts and insights.

8.4. Feedback: If you send us any feedback, ideas, or suggestions regarding the App, you agree that Novastro is free to use them for any purpose (including developing new features) without any compensation or credit to you.

9. User Conduct

You agree NOT to:

Use the App for any illegal purpose.
Harass, abuse, or harm another person (including sending unwanted friend requests).
Upload or transmit any content that is illegal, offensive, or violates the rights of others.
Share the personal birth data of third parties without their explicit consent.

10. Indemnification

You agree to indemnify, defend, and hold harmless Novastro and its officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any rights of a third party (including intellectual property or privacy rights).

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVASTRO OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APP, EVEN IF NOVASTRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Dispute Resolution and Governing Law

12.1. Informal Resolution: In the event of any dispute, you agree to first contact us at support@hyperaven.com and attempt to resolve the matter informally. We will make good faith efforts to settle any dispute within fifty (50) days.

12.2. Governing Law and Jurisdiction: If the dispute is not resolved informally, this Agreement shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of law principles. Any legal action arising out of or relating to this Agreement shall be brought exclusively in the competent courts and enforcement offices of Antalya, Türkiye, and you hereby consent to the personal jurisdiction and venue of such courts.

12.3. Time Limitation: YOU AND NOVASTRO AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

13. Copyright Infringement (DMCA Notice)

If you believe that any content on our App infringes your copyright, please notify us at support@hyperaven.com. Your notice must include: (a) a description of the copyrighted work; (b) where the infringing material is located on the App; and (c) your contact information. We will investigate and take appropriate action, including removing the content if necessary.

14. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App. Your continued use of the Services signifies your acceptance of the modified Terms.
